Introduction

Welcome to FocusRace. These Terms of Use ("Terms") govern your access to and use of the FocusRace Chrome extension, website, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Service. FocusRace ("we," "our," or "us") reserves the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting.

Acceptance of Terms

By installing, accessing, or using the FocusRace Chrome extension or visiting our website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

Description of Service

FocusRace is a Pomodoro timer Chrome extension that enables users to:

  • Use a customizable Pomodoro timer with focus sessions, short breaks, and long breaks
  • Compete anonymously on a global leaderboard by completing Pomodoro sessions
  • View real-time rankings and statistics
  • Customize timer settings and preferences

User Conduct

You agree not to use the Service in any way that:

  • Violates any applicable laws, regulations, or third-party rights
  • Attempts to manipulate, cheat, or exploit the leaderboard system
  • Uses automated scripts, bots, or other means to artificially inflate session counts or rankings
  • Interferes with or disrupts the Service or servers connected to the Service
  • Uses offensive, harmful, or inappropriate display names or content
  • Attempts to reverse engineer, decompile, or extract the source code of the extension

We reserve the right to remove any user from the leaderboard, suspend access, or take other appropriate action if we determine that a user has violated these Terms.

Account and Anonymity

FocusRace is designed to be used anonymously. You are not required to create an account or provide personal information to use the Service. However:

  • User ID: A unique identifier is generated locally on your device to track your sessions and leaderboard position.
  • Display Name: You may choose a display name or use an automatically generated anonymous alias. You are responsible for ensuring your display name complies with these Terms.
  • Anonymity Mode: You can enable anonymous mode to appear on the leaderboard without revealing your display name.

Intellectual Property

The Service, including but not limited to the Chrome extension, website, logos, graphics, and software, is owned by FocusRace and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to:

  • Modify, copy, or create derivative works of the Service
  • Redistribute, sublicense, or sell the Service
  • Use the Service for commercial purposes without our written permission

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy, reliability, or availability of leaderboard data

We do not guarantee that the Service will meet your requirements or that any defects will be corrected. You use the Service at your own risk.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOCUSRACE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data, profits, or business opportunities
  • Service interruptions or unavailability
  • Errors or inaccuracies in leaderboard data
  • Unauthorized access to or use of your data

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us (if any) in the twelve (12) months preceding the claim, or $0 if you have not paid anything.

Service Modifications and Termination

We reserve the right to:

  • Modify, suspend, or discontinue the Service or any part thereof at any time with or without notice
  • Terminate or suspend your access to the Service for violation of these Terms
  • Remove or modify leaderboard data, rankings, or user submissions at our discretion

We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service. You may stop using the Service at any time by uninstalling the extension.

Indemnification

You agree to indemnify, defend, and hold harmless FocusRace, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, violation of these Terms, or infringement of any rights of another party.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FocusRace operates, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

  • Posting the updated Terms on this page with a new "Last updated" date
  • Notifying users through the extension or website (if applicable)

Your continued use of the Service after any changes to these Terms constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely approximates the intent of the original provision.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FocusRace regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral.
